Terms of service
1. About these terms
These terms apply to your use of axiomaitech.dev and to services provided by Axiom AI Testing (“Axiom AI Testing Solutions”, “we”, “us”), a firm registered in India. Our services are for businesses only. If you engage us, these terms apply together with the proposal, statement of work or contract we agree with you (the “Agreement”). If they conflict, the Agreement wins.
2. Using this website
You may view and share this website for lawful purposes. You must not attempt to disrupt it, gain unauthorised access, or copy its content for commercial use without permission. The website content is provided for general information only and is not professional, legal or compliance advice.
3. Engagements
- Scope. Each engagement's scope, deliverables, timeline and fees are set out in the Agreement. Work outside that scope is a change request and may be charged separately.
- Your responsibilities. You will provide the access, information and test environments we reasonably need, and confirm you have the right to let us test the systems and data involved.
- Authorised testing only. We test only systems you own or are authorised to have tested, within the limits agreed in writing.
- Nature of testing. Testing reduces risk; it cannot prove that an AI system is free of errors, bias or vulnerabilities. Our reports reflect the system as tested at the time. We do not certify compliance with any law or standard.
4. Fees, invoices and payment
- Fees and currency (for example GBP, USD or INR) are as stated in the Agreement or invoice.
- Unless agreed otherwise, invoices are payable within 30 days of the invoice date by bank transfer to the account shown on the invoice.
- Fees exclude taxes. Where Indian GST applies, it will be shown on the invoice. Supplies to clients outside India may qualify as an export of services. Each party bears its own bank charges, and any withholding tax is handled as required by law.
- We may pause work if an invoice is more than 30 days overdue, after giving you written notice.
See Cancellations and refunds for what happens if an engagement is cancelled.
5. Confidentiality and data
Each party will keep the other's confidential information secret and use it only for the engagement. Where we process personal data on your behalf, we do so only on your documented instructions, under data processing terms in the Agreement, and in line with our privacy policy.
6. Intellectual property
Once you have paid in full, you own the reports and test datasets we create specifically for you. We keep ownership of our pre-existing tools, methods and know-how, and grant you a non-exclusive licence to use any of them included in the deliverables for your internal purposes. We will not name you as a client without your permission.
7. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law. Subject to that, neither party is liable for indirect or consequential loss, or for loss of profit, revenue or data, and our total liability for an engagement is limited to the fees paid for that engagement in the 12 months before the claim.
8. Ending an engagement
Either party may end an engagement by written notice if the other materially breaches the Agreement and does not fix the breach within 14 days of being asked. Other termination rights are set out in the Agreement and our cancellations and refunds policy.
9. Law and disputes
Unless the Agreement says otherwise, these terms are governed by the laws of India, and the courts at Hyderabad, Telangana, India have jurisdiction. Before going to court, both parties will try in good faith to settle any dispute through discussion between senior representatives for at least 30 days.
10. Changes and contact
We may update these terms by posting a new version here. Changes don't affect an Agreement already signed. Questions: hello@axiomaitech.dev.
